Patient Access Request

Summary

This online portal has been designed to assist individuals, and/or their representatives, to access copies of the information held about them by University Hospital Southampton NHS Foundation Trust (‘the Trust’). Service users, staff members, and those authorised to act on the behalf of others can use this portal to submit ‘Subject Access Requests’ (see below).

University Hospital Southampton NHS Foundation Trust  (UHS) has the authority to provide documents related to UHS matters. Requests for such documents from other hospitals , including Winchester, Andover and  Basingstoke should be made directly to them.  

Subject Access Requests – For adults and children’s records 
 
Article 15 of the UK General Data Protection Regulation (UK GDPR) gives individuals, and/or their authorised representatives, the right to access copies of the information that an organisation holds on them – with some exemptions. These requests are known as Subject Access Requests (SARs). There is no charge for SARs; except in certain circumstances - such as if the request is deemed to be excessive or ‘manifestly unfounded’. 
 
Before the Trust can process a SAR, we need to ensure that we have verified the applicant’s identity and, for representatives, that they have the necessary consent (or legal basis) to act on behalf of the individual. 
 
Access to Health Records Request - For Deceased Patients Records
 
The Access to Health Records Act 1990 (AHRA) provided a small cohort of people with a statutory right to apply for access to information contained within a deceased person's health records. These individuals are defined under section 3(1)(f) of the Act as the patient's personal representative and any person who may have a claim arising out of the patient's death. A personal representative is the executor or administrator of the deceased person's estate

Freedom of Information Requests (FOI) Act 2000 & Environmental Information Regulations requests 2004 (EIRs) 

The Freedom of Information Act 2000 and Environmental Information Regulations 2004 covers all recorded information that is held by, or on behalf of a public authority in England, Wales and Northern Ireland, within the scope of the Act or the Regulation, these do not give individuals access to their own personal data (information about themselves) .  These are handled under Article 15 of the UK General Data Protection Regulation (UK GDPR) and as such individuals should make a Subject Access Request. 

How to make a request

This Online portal may be used to make a Subject Access Request or Access to Health Records Request to the Trust for access to our patient records. 
 
You can make a Subject Access Request for copies of the information the Trust holds on you by creating an account and logging into the portal. The portal will enable you to submit your request, view the progress, and then let you download copies of the relevant information.
